Resumo: Este trabalho busca discutir a mudança do marco regulatório no setor petrolífero brasileiro a partir da avaliação dos impactos das recentes descobertas de petróleo sob a camada pré-sal da costa marítima em seus aspectos políticos, sociais e, principalmente, econômicos. Assim, para entender os desdobramentos dessa modificação, se faz necessário avaliar os distintos conjuntos de regras que regem as atividades de exploração e produção de petróleo, assim como da distribuição das receitas obtidas com a comercialização destes recursos. Dessa forma, são apresentados os principais modelos jurídico-regulatórios adotados pelos grandes produtores de petróleo ao redor do mundo e suas principais características. Por fim, o trabalho culmina no debate acerca do marco regulatório a ser adotado para o setor de petróleo após a confirmação das descobertas do pré-sal, no intuito de apresentar as principais visões sobre o novo modelo, seja do ponto de vista setorial e microeconômico, seja em relação aos desafios macroeconômicos e aos anseios da nação em termos do seu desenvolvimento socioeconômico

Abstract: This study sought to discuss the changes in the regulatory model for the Brazilian oil industry from the assessment of the impacts of recent oil discoveries in the pre-salt layer of the sea coast in its political, social and especially economic aspects. Thus, to understand the implications of this chance, it is necessary to evaluate the different sets of rules governing the activities of exploration and production of oil, as well as the distribution of the revenues from the sale of these resources. Therefore, the main legal and regulatory models adopted by the major oil producers around the world and its main characteristics are presented. Finally, the work culminates in the debate about the regulatory model to be adopted for the oil industry after the confirmation of the pre-salt discoveries in order to present the main views on the new model, either in terms of sectors and microeconomic, or in relation to the macroeconomic challenges and desires of the nation in terms of its socioeconomic development
