Resumo: Agamben caracteriza o estado moderno como lugar de ‘gestação’ da biopolítica, ou melhor, de seu ‘parto’. Os direitos e garantias fundamentais do cidadão, o livre-arbítrio e a adesão a um contrato social são o verniz que torna opaco a real base de constituição do Estado Moderno: a vida nua. A estrutura política originária é a decisão soberana sobre a exceção, posto que enceta em seus termos o princípio de localização de toda ordem jurídica, a partir da qual é possível vincular o conjunto normativo a um território e onde o horizonte de atuação política das formações estatais modernas ganha sentido a partir daquilo que é incluído ou excluído do ordenamento. O ordenamento do espaço não é apenas a tomada da terra e a fixação de uma ordem jurídica sobre um território, mas, essencialmente, a constituição da exceção. O estado de exceção, com base nesse pressuposto, é um instrumento de atuação do projeto biopolítico caracterizado pela barbárie, matabilidade, é o que resta quando se rompe o véu da constituição e de uma vida organizada pelo respeito inconteste aos direitos e garantias fundamentais com sede na constituição à cargo dos representantes do povo nos estados de direito. Com base nesse pressuposto, busca-se desvelar como, a um só tempo, realidades opostas parecem coexistir em um mesmo espaço e tempo, notadamente em sistemas políticos tão distintos: democrático e totalitarismo. Abstract: Agamben characterizes the modern state as the 'gestation' of biopolitics, or rather its 'birth'. The fundamental rights and guarantees of the citizen, free will and adherence to a social contract are the varnish that makes the real basis of the constitution of the modern state opaque: bare life. The original political structure is the sovereign decision on the exception, since it establishes in its terms the principle of localization of every legal order, from which it is possible to link the set of rules to a territory and where the horizon of political action of modern state formations gains meaning from what is included or excluded from the order. The ordering of space is not just the taking of land and the establishment of a legal order over a territory, but essentially the constitution of the exception. The state of exception, based on this assumption, is an instrument for carrying out the biopolitical project characterized by barbarism and killability. It is what remains when the veil of the constitution and a life organized by unconditional respect for fundamental rights and guarantees, based on the constitution, is broken by the representatives of the people in states governed by the rule of law. Based on this assumption, the aim is to reveal how, at the same time, opposing realities seem to coexist in the same space and time, especially in such different political systems: democracy and totalitarianism.
